Decision Types and Folder Structure


There are two major types of zoning permit decisions:

  • Primary - Decisions on the permit request itself.

  • Secondary - Decisions subsequent to the permit application decision. These do not affect the validity of the permit, only the administrative mechanics around it.

All Primary decisions are appealable, and most Secondary decisions are also appealable.

Primary Decisions

Primary decision info are found at the Folder level:

  • Primary Decision dates are found under FolderInfo (Info tab).

  • Programming control of Appeal Periods dates use Folder.IssueDate (decision date) and Folder.ExpiryDate (appeal period end date).

  • Folder.FinalDate records when the folder lifecycle ended - the Folder Status became Final CO Issued, Request Denied, Review Complete, etc.

  • The use of FolderProcessChecklists for the review path (Admin or DRB, as well as DAB and CB) are the same for Primary and Secondary decisions.

  • The Land Records (Clerk's) Filing Fee is collected for Primary decisions.

Primary Decision Processes:

Process Code Use
Project Decision 10005 Administrative or DRB Decision on a zoning permit request.
Appeal to DRB 10002 DRB decision on an appeal of an administrative decision.
Appeal to VEC 10003 VEC decision on an appeal of a DRB decision.
Non-Applicability Request 10010 Administrative decision on whether a zoning permit is required.
Determination Decision 10016 Usually an administrative determination concerning a property relative to the zoning ordinance.
Revoke Permit 10004 Administrative decision to revoke an approved permit because applicant misrepresented the facts.

Secondary Decisions

Secondary decision info are found at the Process level:

  • Secondary Decision dates and appeal period end dates are found under FolderProcessInfo for the process controlling the secondary decision, such as Extend Permit Expiration.

  • The Land Records (Clerk's) Filing Fee is NOT collected for Secondary decisions.

Secondary Decision Processes:

Process Code Use
Extend Permit Expiration 10020 Upon written request, the permit expiration date may be extended by one year.
Waive Right to Appeal 10028 If no interested parties participate in a DRB decision, the applicant can waive his/her appeal and reconsideration rights, ending the 30-day appeal period and the permit imediately becomes available for release. Since there are no interested parties, once the applicant waives their right to appeal, no one can appeal. Therefore the decision to waive is by definition not appealable.
